The Fifth Circuit Court of Appeals will not revive an African American attorney’s efforts to have the Confederate emblem removed from the Mississippi State Flag. But Carlos Moore isn’t stopping there – he says he’ll appeal to the Untied States Supreme Court next, the AP reports.

In 2016, Moore filed a suit in which he called the flag “state-sanctioned hate speech” that romanticizes the legacy of slavery and segregation.

Moore’s case was dismissed by a federal judge in September, who said Moore did not have the legal standing to file suit.
